Article III - Arbitration
December 7, 1990
Section A. Disputes, claims, or grievances arising out of or relating to the interpretation or the application of the Condominium Documents, or any disputes, claims or grievances arising among or between co-owners and the Association shall, upon the written notice to the association, be submitted to arbitration and the parties thereto shall accept the arbitrator's decision as final and binding. The Commercial Arbitration Rules of the American Arbitration Association as amended and in effect from time to time hereafter shall be applicable to any such arbitration. Section B. Election by co-owners or the association to submit any such dispute, claim or grievance to arbitration shall preclude such parties from litigating such dispute, claim or grievance in the courts. Section C. Except as otherwise hereinabove stated in Section B of this Article III, neither a co-owner nor the Association shall be precluded from petitioning the courts to resolve any such disputes, claims or grievances. |
